by Dragonspear

One of the biggest gamers sues one of the biggest eSports teams. Who is right? Who is the bad guy? Will it change eSports forever? Legal Eagles get 2 months of unlimited learning on SKILLSHARE for FREE:

Tfue, one of the biggest gamers on the planet, accuses FaZe Clan of an oppressive contract and pure exploitation. FaZe Clan fires back that Tfue is making things up to get out of the contract so he can start his own eSports company. Tfue not only files suit in Los Angeles, but also filed a petition with the California Labor Commission, arguing that FaZe Clan should be regulated like a talent agency. The outcome of that petition could have wide ranging implications for all of eSports.

Who will win the lawsuit?

So for anyone wanting an update: Faze did countersue in New York.

A California judge dismissed Tfue's suit.

They settled before going to trial, the terms of which were not released.

Sounds to me like Tfue didn't actually have a case after all and Faze was the one acting in good faith, though that original contract does seem onerous.

12:22 Not sure what the graphic represents, that is Jack Tenney(JOOG Squad) on the left (before) and Turner Tenney(TFue) on the right(after)

With zero legal background whatsoever, I’d rule with FaZe Clan. He signed a contract, they showed due diligence and willingness to renegotiate. On paper I’d support FaZe.

If I was a competing company, I wouldn’t touch TFue because of his conduct under one contract. As far as the “pressure to drink and gamble.” I doubt that officials from Faze were the ones pressuring, likely team mates, and it probably didn’t take that much

Cry baby doesn’t like his work contract and thinks 3 years is a long time. Boo-hoo

City Watch Guard 14/09/2021 - 8:20 PM

I don’t like Fortnite really and I’m glad I didn’t get into it because it seems rather teeth grindingly cringy to me, and if you are not being unbearable then you are being extremely toxic as you are bullying teammates because they were not good enough, or at least that’s how it is with some competitive people

Krytern 14/09/2021 - 8:20 PM

Is that it? Three years? He is whining and saying he is oppressed over a three year contract?

Worra 14/09/2021 - 8:20 PM

Huh Faze seems to be in the right TBH

Diconica Bastion 14/09/2021 - 8:20 PM

Considering the statement Faze Clan made about what they received and exercised of the contract by their own admission they have failed to enforce the contract. I can't remember the legal term for when a party fails to enforce the contract and that becomes the expected. It can make the contract unenforceable.

Buried Alive 14/09/2021 - 8:20 PM

I think sports players should be held to their contracts. Look at Marshawn Lynch. Great player but breached his contract just because he could, and because the team needed him. He wouldn't talk at press meetings, or do many other things he promised to do if they paid him. He accepted the money and Super Bowl or not, he should have been made to honor his contract. People like him set a terrible example.

oof oof 14/09/2021 - 8:20 PM

the fact this guy can say "gamer agreement" without laughing is amazing

William Lansberry 14/09/2021 - 8:20 PM

FaZe clan encourages the use of cheats and hacks by its members. It is named after a popular piece of game hacking software. They should be banned from all competitive play.

king james488 14/09/2021 - 8:20 PM

well he's right, he's an idiot and should have read what he was signing.

This contract is no longer advantageous to me, therefore it is invalid.

B-Wrecks10 14/09/2021 - 8:20 PM

Objection! 12:16 Before and after picture is inaccurate. Those pictures are two different people, one of them being Jack Tenney of the Youtube channel Joogsquad (Tfue's brother) and the other of being of Tfue himself. Those are not before and after pictures.

Blackrain707 14/09/2021 - 8:20 PM

This seems to echo how music contracts work.

Rabbid Doggoo 14/09/2021 - 8:20 PM

Plot Twist: these days Tfue is doing Minecraft speedruns 🤣

Mike Loeven 14/09/2021 - 8:20 PM

16600 should be adopted at the federal level IMO

Erik Raudr 14/09/2021 - 8:20 PM

He signed, case lost.

Robert Andrews 14/09/2021 - 8:20 PM

He signed a contract when he was a nobody, you can't backtrack later. It defeats the purpose of a contract. Don't sign something you don't understand, it's always foolish and that you don't intend to follow. He should lose this and I hope he does. Remember the days when your word had power, if someone said they would do something they would no excuses. . It's sad you can't trust anyone these days

Andrew Huang 14/09/2021 - 8:20 PM

Personally I did not realise he has any basis to argue a case as long as he was paid whatever the min wage is, he has the freedom to sign or not sign the contract

Alec Kennis 14/09/2021 - 8:20 PM

He’s the one that signed it tho lmao

Raymundo Neto 14/09/2021 - 8:20 PM

Players are quick to accept help from orgs when they are trying to make it…And as soon as they make a little name for themselves it's like "screw this org"…The contract wasn't so bad when he needed it, huh? And don't give me that "I didn't know what I was doing" bulls…Bottom line is, orgs invest their money and take ALL the risk, while players take no risk at all and find a way to complain…A..holes

Jay Santillano 14/09/2021 - 8:20 PM

Sounds like t was drunk when he signed it . It’s on him . Contract is a contract

Blazinfireball88 14/09/2021 - 8:20 PM

12:21 thats tfues brother…

Keovar 14/09/2021 - 8:20 PM

I don't find him entertaining, but I can see categorizing PewDiePie as an entertainer. For a competitive game like Fortnite (don't care about it either), why wouldn't its players be treated the same as physical athletes? Just as a sportsball player signs on to a sports team, a clickshoot player signs on to an esports team. Makes sense to me.
